End user license agreement (EULA)

This End User License Agreement ("Agreement") is a legal agreement between you ("User") and DigiSys Web Services s.r.o. ("Company", "we", "our", or "us") for the use of our mobile applications and related services (collectively, the "App").

By downloading, installing, or using the App, you agree to be bound by this Agreement. If you do not agree, do not download or use the App.

1. License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, subject to the Apple Media Services Terms and Conditions and this Agreement.

This license does not allow you to:

  • Distribute or make the App available over a network where it could be used by multiple devices at the same time
  • Copy, decompile, reverse engineer, disassemble, modify, or create derivative works of the App, except as permitted by applicable law
  • Rent, lease, lend, sell, sublicense, or transfer the App to any third party
  • Remove, alter, or obscure any proprietary notices in the App

2. Subscriptions and In-App Purchases

The App offers optional subscription plans through Apple In-App Purchases that unlock premium features.

  • Subscription prices are displayed in the App Store before purchase
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current billing period
  • Your account is charged for renewal within 24 hours prior to the end of the current period at the same price
  • You can manage and cancel subscriptions in your device Settings → Apple ID → Subscriptions
  • No refund is provided for the unused portion of a subscription period
  • Refund requests must be submitted through Apple's support

Free features remain available without a subscription. The scope of free and premium features is described on each App's store listing.

3. App-Specific Terms

3.1 Manager for Joomla!

This App connects to your Joomla websites using the Joomla REST API. By using it, you acknowledge that:

  • The App can create, read, modify, and delete content on your Joomla websites, including articles, categories, users, media, menus, modules, tags, custom fields, configuration, languages, and extensions
  • The App can install and update extensions on your Joomla websites
  • You must have proper authorization to manage any website you connect to the App
  • The companion Joomla plugin (DS Joomla Mobile) enables additional features: media upload, SSO admin login, site maintenance, and push notification webhooks
  • Push notifications are delivered through our relay server (push.digisysweb.com), which stores your device token, site URL, and notification preferences
  • The relay server monitors your website availability and checks for available Joomla updates
  • You are responsible for maintaining backups of your websites before performing updates or configuration changes through the App

3.2 Manager for VirtueMart

This App connects to your VirtueMart/Joomla websites using the Joomla REST API. By using it, you acknowledge that:

  • The App can create, read, modify, and delete products, orders, categories, and media on your VirtueMart websites
  • Order management actions (status changes, deletions) may trigger customer notifications depending on your VirtueMart configuration
  • All terms from section 3.1 regarding the Joomla plugin, push notifications, and relay server apply equally
  • You are responsible for the accuracy of product and order data managed through the App

3.3 GroupListo

This App stores data locally on your device and optionally syncs via your personal iCloud account. By using it, you acknowledge that:

  • The App does not connect to any external servers operated by us
  • iCloud sync depends on your Apple ID and iCloud service availability
  • We are not responsible for data loss due to iCloud sync issues or device loss

4. External Services

Manager for Joomla! and Manager for VirtueMart connect to external services not operated by Apple:

  • Your Joomla websites — all API communication happens directly between your device and your websites over HTTPS
  • Our relay server — for push notification delivery, website monitoring, and Joomla update detection

These external services are necessary for core App functionality. Network access is required. The App may not function correctly without an internet connection or if your Joomla websites are unreachable.

5. Data and Privacy

Your use of the App is subject to our Privacy Policy, available at https://www.digisysweb.com/privacy-policy. Key points:

  • Joomla API tokens are stored in the iOS Keychain, encrypted by the operating system
  • Push notification device tokens and site registrations are stored on our relay server
  • API communication with your Joomla websites is direct (device to server) over HTTPS
  • We do not use third-party analytics, advertising, or tracking services in the App
  • GroupListo does not transmit any data to our servers

6. Intellectual Property

The App and all its content, features, and functionality are owned by DigiSys Web Services s.r.o. and are protected by copyright, trademark, and other intellectual property laws.

The companion Joomla plugin (DS Joomla Mobile) is distributed under the GNU General Public License version 2 or later.

7. Disclaimer of Warranties

The App is provided "as is" without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, whether express, implied, or statutory, including:

  • Merchantability and fitness for a particular purpose
  • Uninterrupted or error-free operation
  • Compatibility with all Joomla or VirtueMart versions and configurations
  • Accuracy or completeness of data retrieved from your websites
  • Timely delivery of push notifications

8. Limitation of Liability

To the maximum extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of data, content, or configuration on your Joomla websites
  • Website downtime resulting from actions performed through the App
  • Failed extension updates or incompatibilities
  • Incorrect order processing or inventory discrepancies (VirtueMart)
  • Failed or delayed push notification delivery
  • Loss of business or revenue

Our total liability shall not exceed the amount you paid for the App or subscription in the preceding 12 months.

9. Termination

This Agreement is effective until terminated. Your rights under this Agreement will terminate automatically if you fail to comply with its terms.

Upon termination:

  • You must cease all use of the App
  • Push notification registrations on our relay server will be deactivated
  • Data stored locally on your device remains until you delete the App
  • You retain access to your Joomla websites through other means

10. Apple's Role

You acknowledge that:

  • This Agreement is between you and DigiSys Web Services s.r.o., not with Apple
  • Apple is not responsible for the App or its content
  • Apple has no obligation to provide maintenance or support for the App
  • In the event of any failure of the App to conform to applicable warranties, Apple's maximum liability is limited to refunding the purchase price of the App (if any)
  • Apple is not responsible for any claims relating to the App, including product liability, legal compliance, or intellectual property infringement
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you

11. Governing Law

This Agreement shall be governed by and interpreted in accordance with the laws of Slovakia, without regard to conflict of law principles. Any disputes shall be subject to the jurisdiction of the competent courts of Slovakia.

12. Changes to This Agreement

We may update this Agreement from time to time. Updates will be posted on our website. Continued use of the App after changes constitutes acceptance of the updated Agreement.
