Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the website, applications, software, plugins, and related digital services (collectively, the "Services") provided by DigiSys Web Services s.r.o. ("Company", "we", "our", or "us").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Use the Services in violation of applicable laws or regulations
  • Attempt to gain unauthorized access to systems or data
  • Reverse engineer, decompile, or disassemble software unless permitted by law
  • Interfere with the security or proper functioning of the Services
  • Distribute malware or harmful code
  • Use our mobile apps to manage websites you do not own or have authorization to manage
  • Share, resell, or redistribute Joomla API tokens or account credentials used with our Services

We reserve the right to suspend or terminate access if these Terms are violated.

3. Accounts and Access

Certain features may require account registration or authentication. You are responsible for:

  • Maintaining the confidentiality of your credentials (including Joomla API tokens)
  • All activities occurring under your account or device
  • Providing accurate and up-to-date information
  • Ensuring your Joomla websites are properly secured and updated

We may suspend or terminate accounts that violate these Terms.

4. Intellectual Property

All intellectual property rights in the Services, including but not limited to software, source code, design, text, graphics, logos, and trademarks, are owned by or licensed to the Company.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the Services for their intended purpose.

You may not copy, modify, distribute, sell, or sublicense any part of the Services without prior written consent.

5. Payments and Subscriptions

Some Services require payment or subscription through Apple In-App Purchases.

5.1 Pricing and Billing

  • Prices are displayed in the App Store before purchase
  • Subscriptions renew automatically unless cancelled before the end of the current billing period
  • Payment is charged to your Apple ID account at confirmation of purchase
  • Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
  • Your account is charged for renewal within 24 hours prior to the end of the current period

5.2 Cancellation

To cancel a subscription, open your device Settings → Apple ID → Subscriptions, select the subscription and tap Cancel. Cancellation takes effect at the end of the current billing period. You retain access to premium features until the subscription expires.

5.3 Refunds

All purchases are processed by Apple. Refund requests must be submitted through Apple's support channels. We do not process refunds directly.

5.4 Free Features

Basic features of our apps are available without a subscription. The specific features included in free and premium tiers are described on each app's App Store listing.

6. App-Specific Terms

6.1 Manager for Joomla!

This app connects to your Joomla websites using the Joomla REST API. By using this app, you acknowledge and agree that:

  • You are solely responsible for the websites you connect to the app and must have proper authorization to manage them
  • The app can create, modify, and delete content on your Joomla websites (articles, categories, users, media, menus, modules, tags, custom fields, configuration, and extensions)
  • Installing our companion Joomla plugin (DS Joomla Mobile) enables additional features including media upload, SSO admin login, site maintenance operations, and push notification webhooks
  • Push notifications require registering your device token and site URL with our relay server
  • Extension updates performed through the app carry the same risks as updating through the Joomla administrator panel — always maintain backups
  • We are not responsible for data loss, website downtime, or configuration issues resulting from actions performed through the app
  • API tokens are stored securely in the iOS Keychain, but you are responsible for revoking tokens if your device is lost or compromised

6.1 Manager for VirtueMart

This app connects to your VirtueMart/Joomla websites using the Joomla REST API. By using this app, you acknowledge and agree that:

  • You are solely responsible for the websites you connect to the app and must have proper authorization to manage them
  • The app can create, modify, and delete products, orders, categories, and media on your VirtueMart websites
  • Order management actions (status changes, deletions) performed through the app are final and may trigger customer notifications depending on your VirtueMart configuration
  • The same plugin, push notification, and security terms as Manager for Joomla! apply
  • We are not responsible for incorrect order processing, inventory discrepancies, or financial losses resulting from actions performed through the app

6.3 GroupListo

This app stores data locally on your device and optionally syncs via your personal iCloud account. By using this app, you acknowledge and agree that:

  • Data availability depends on your iCloud account status and Apple's iCloud service
  • We are not responsible for data loss due to iCloud sync failures, device loss, or iOS data management
  • Shared lists are governed by Apple's iCloud sharing functionality

7. Push Notifications

Our mobile apps (Manager for Joomla!, Manager for VirtueMart) offer push notifications through our relay server. By enabling push notifications, you agree that:

  • Your Apple Push Notification device token and site URL are transmitted to and stored on our relay server
  • Our Joomla plugin sends event data (article titles, usernames, site status) to the relay server when events occur on your website
  • The relay server monitors your website availability and checks for Joomla updates
  • Notifications are delivered on a best-effort basis — we do not guarantee delivery timeliness or completeness
  • You can disable notifications at any time per site in the app, or globally in iOS Settings

8. Joomla Plugin

Our companion Joomla plugin (DS Joomla Mobile) is provided as part of the Services. By installing the plugin on your Joomla website, you agree that:

  • The plugin sends webhook notifications to our relay server when certain events occur (new articles, new users)
  • The plugin reports your Joomla version to our relay server for update detection
  • The plugin provides additional API endpoints for mobile app functionality
  • You are responsible for keeping the plugin updated
  • The plugin is licensed under the GNU General Public License version 2 or later

9. Third-Party Services

Our Services integrate with or rely on third-party platforms. We are not responsible for:

  • The availability or performance of your Joomla websites
  • Apple's App Store, In-App Purchase, iCloud, or Push Notification services
  • Changes made by Joomla, VirtueMart, or other third-party software
  • Data handling practices of third parties

Your use of third-party services is subject to their respective terms.

10. Disclaimer of Warranties

The Services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties, express or implied, including but not limited to:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Availability or uninterrupted operation
  • Compatibility with all Joomla versions or configurations
  • Accuracy of data retrieved from your websites via the Joomla API

We do not guarantee that the Services will be error-free or secure.

11. Limitation of Liability

To the maximum extent permitted by law, DigiSys Web Services s.r.o. shall not be liable for:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, data, or business opportunities
  • Website downtime or data corruption caused by actions performed through our apps
  • Failed or delayed push notifications
  • Extension update failures or incompatibilities
  • Service interruptions
  • Security breaches beyond our reasonable control

Our total liability shall not exceed the amount paid by you (if any) for the relevant Service in the preceding 12 months.

12. Indemnification

You agree to indemnify and hold harmless DigiSys Web Services s.r.o. from any claims, damages, liabilities, or expenses arising from:

  • Your misuse of the Services
  • Unauthorized management of websites through our apps
  • Violation of these Terms
  • Violation of applicable laws

13. Termination

We may suspend or terminate access to the Services at any time if:

  • You violate these Terms
  • Required by law
  • We discontinue the Service

Upon termination:

  • Your right to use the Services ceases immediately
  • Your device registrations on our relay server will be deactivated
  • Data stored locally on your device remains until you delete it
  • You retain access to your Joomla websites through other means

14. Updates and Modifications

We may update or modify the Services, features, functionality, and these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Slovakia, without regard to conflict of law principles. Any disputes shall be subject to the jurisdiction of the competent courts of Slovakia.

16. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full force and effect.
